CASE STUDY:
Claim:
The plaintiff broke his neck during athletic activities. The surgeons successfully operated on him, fusing vertebrae together and inserting rods in his neck, however, the plaintiff sued the surgeons for malpractice.
Injury:
The plaintiff stated that the surgery left him incapacitated, requiring the constant use of a neck brace and a walking aid. He needed assistance in all aspects of life and was no longer able to work as an expert consultant.
Investigation:
During our investigation, the plaintiff demonstrated strength, mobility, dexterity and full range of motion. The plaintiff was observed riding a bicycle, loading his bike in and out of his vehicle, carrying large objects, extending and reaching, wearing a water bladder on lenghty hikes, and working as a soccer referee. ONLY at the investigator’s deposition was the claimant ever observed with a neck brace. He eventually dropped the potential seven figure case.
